One of our brokers represents a buyer. The buyer writes an offer and the seller counters on price. The buyer does a counter back on price, adding the words “as is” after the price. When the buyer’s broker presents the seller’s broker with the buyer’s counter offer, he includes a letter stating: “Please note that the buyer’s intention is to purchase the property at this price in “as is” condition. The buyer will not be asking the seller for repairs to be completed by the sellers prior to closing.” The seller accepts the counter offer. The home inspection is completed confirming the home is in need of extensive repairs. The buyer submits an addendum asking for a price reduction due to the extent of repairs needed. The seller’s attorney states that the “as is” clause constitutes a waiver of the home inspection. Did the buyer waiver their right to ask for a reduction in price based on the inclusion of an “as is” clause?
