Removing Discriminatory Language from Deeds and CC&Rs
Deeds/Titles:
Thanks to the passage of House Bill 4134 during the 2018 legislative session, a bill introduced by Representative Fahey, property owners are able to remove discriminatory language from their property titles by petitioning their county’s circuit court (with no fee) using the following form:
Petition to Remove Discriminatory Provisions from Title to Real Property
The Oregon laws authorizing a streamlined process for removing racial covenants from deeds are contained in ORS 93.270 (Certain restrictions in conveyancing instruments prohibited; restriction on right of action) and ORS 93.274 (Procedure for removal of discriminatory restrictions).
CC&Rs and Homeowner Associations:
In 2021, the Oregon legislature passed House Bill 2534. This bill requires homeowners associations and condominium associations to review governing documents – such as CC&Rs – and remove any discriminatory language on or before December 31, 2022.
